Benjamin was born in Robinson Road, Mushlatubbee Dst, Choctaw Nat, MS, 1829. Benjamin was the son of Elijah Smallwood and Mary LeFlore. Benjamin died 15 DEC 1891 nr Lehigh, Atoka Co., Choctaw Nation, IT, at 62 years of age. His body was interred DEC 1891 in Smallwood Cem., nr. Lehigh, Coal Co., OK. He was listed as a resident in the census report on '1855' Choctaw Roll, Kiamitia Co., Choctaw Nation, IT, 1856. Benjamin's occupation: Choctaw Chief in Choctaw Nation, IT, 1888-1890.

Benjamin married (1) Annie BURNEY in 1849 in Indian Territory, Choctaw Nation. Annie was born in 1835 in Chickasaw Nation, MS. She died about 1863.

She was listed as a resident in the census report on '1855' Choctaw Roll, Kiamitia Co., Choctaw Nation, IT, NOV/DEC 1856. ANNIE BURNEY FACTS & SPECULATIONS There is a very strong probability that Annie Burney is the missing daughter of David Calhoun Burney and Lucy James. On the 1840 Mississippi Census, David Burney is shown to have three female children living in his household. Two of these females are known to be Amanda and Susan Burney. The third young female has no where been identified. The earliest known Indian roll after the 1840 census that last the names of all the family members on which the David Burney family appears if the so called "1855 Choctaw Roll" which was actually made in late 1856. There is no "third" daughter on this roll which would fit with the "young female" of the 1840 census. Recently early manuscripts written by Peter Hudson, nephew of early Choctaw chief Hudson, have come to light. In his notes concerning the families of the various early Choctaw chiefs, he comments that in 1849, Ben Smallwood married a Chickasaw woman named Annie Burney. Since there is only one known Chickasaw Burney family in existance at this time in Chickasaw history, it is to be assumed that Annie Burney is in fact the missing third daughter of David Burney. Another family story has surfaced that indicates that Annie Burney may have been a sister of David Calhoun Burney and not his daughter. All that can really be said is that she is in some way related to David Burney, part Chickasaw, and a descendant of the Colbert and Allen families. Until further evidence is discovered, she will be carried as David's missing third daughter based on the 1840 Census information. "Chronicals of Oklahoma" article, (Vol.XIX, No.3, p.213), about Choctaw Chief Benjamin Franklin Smallwood, states that his first wife was Annie Burney, a Chickasaw woman of the house of Ima-te-po of the family of Okla-pa-nubbii.
