2 CONT  Wherever frontiersmen ventured, there seem to have been Bransons. Some followed their Caroli
2 CONC na neighbor, Daniel Boone, into Kentucky. Some went to Tennessee, perhaps along with the Croc
2 CONC kett family, who were also neighbors back in Virginia. One of four Branson cousins who left N
2 CONC orth Carolina to settle in Tennessee about 1789 was John Branson, a great-grandson of Thomas
2 CONC . John's grandson, born just west of Chattanooga, Tennessee, in 1819, was named for the her
2 CONC o of the Battle of New Orleans of the War of 1812 (in which we also find Bransons fighting)
2 CONC , and became Andrew Jackson Branson. According to Mr. Joseph M. Branson of Kansas City, Misso
2 CONC uri, this was the branch of the Branson family which moved to Gasconade County, Missouri in 1
2 CONC 829, when that area was the nation's westernmost frontier. Most of the Bransons had large fam
2 CONC ilies, and Andrew Jackson Branson was no exception. He married in 1841 and he and his wife ha
2 CONC d eleven children.

2 CONT Among the children of Andrew Jackson Branson, we find several who, fascinated as their ancest
2 CONC ors had been by the magic of the words "Go west", headed across the plains and the mountain
2 CONC s to California, Nevada and Colorado, establishing branches of the Branson family in the fa
2 CONC r west, where they are still well represented today. In the years that A. J. Branson's childr
2 CONC en were growing up, there were other Bransons journeying to California in the fever of the Go
2 CONC ld Rush.

2 CONC ives, to constitute the "Legislative Assembly" of the Territory. The vote was to be by ballot
2 CONC . As there were yet no county or ether municipal organizations, the election districts were p
2 CONC rovided for in the proclamation. The Sixth District remained the same as in the election of N
2 CONC ovember 10, 1854. The place designated for holding the polls was the hospital building on th

2 CONT CHAPTER VI 
2 CONT THE FIRST GOVERNOR 
2 CONT H. REEDER, the first Governor of Kansas Territory, arrived at Fort Leavenworth, and assumed t
2 CONC he executive office October 7th, 1854. Soon after, with a party of other officials, he mad
2 CONC e a somewhat extended tour of observation through the eastern part of the Territory, and on h
2 CONC is return that portion was divided into "Election Districts." The district which included For
2 CONC t Scott was denominated the Sixth District, and the metes and bounds were described as follow
2 CONC s: 
2 CONT "Commencing on the Missouri State line in Little Osage river; thence up the same to the lin
2 CONC e of the Reserve for the New York Indians, or the nearest point thereto; thence to and by th
2 CONC e north line of said Reserve to the Neosho river, and up said river to and along south branc
2 CONC h thereof to the head; and thence by a due south line to the southern line of the Territory
2 CONC ; thence by the southern and eastern line of said Territory to the place of beginning." 
2 CONT THE FIRST ELECTIONS. 
2 CONT On November 10th, Governor Reeder issued a proclamation for an election to be held in the Ter
2 CONC ritory the 29th day of November for the election of a Delegate to Congress. Fort Scott was de
2 CONC signated as the place for holding the election for the Sixth District. The house of H. T. Wil
2 CONC son was named as the polling place, and the judges appointed were Thomas B. Arnett, H. T. Wil
2 CONC son and William Godfrey. J. W. Whitfield was the Pro-slavery candidate for Delegate, R. P. Fi
2 CONC nnekin, Independent, and John A. Wakefield Free State. In this district Whitfied received th
2 CONC e entire vote cast, 105. Whitfield resided in Missouri at this time and made no pretense of b
2 CONC eing a citizen of the Territory.

2 CONT Nevertheless this election was grossly fraudulent, not only in this district, but in all othe
2 CONC rs. It will be remembered that the district was nearly 50 by 100 miles square. William Barbee
2 CONC , mentioned above, had been appointed the January before to take the census of the district
2 CONC , and about March 1, thirty days before the election, filed his report giving the number of l
2 CONC egal voters as 253. Many of these voters would have had to travel forty and fifty miles to th
2 CONC e polling place. It is not reasonable to suppose that they took such a journey to vote. Mos
2 CONC t of the votes cast came from covered wagons camped on the Marmaton bottom, "for 1 one day on
2 CONC ly," which Judge Margrave said, "just swarmed over from Missouri." But there was no protest i
2 CONC n this district, and the men took their seats in the Legislature. 
2 CONT Barbee had no opposition. He and Anderson and Williams were voted for by the Pro-slavery men
2 CONC . Hamilton and Margrave received the feeble showing of the opposition. 
2 CONT William Barbee came here from Kentucky at the age of 29. He was a very fair man, and lived he
2 CONC re several years. Barbee street in Fort Scott was named for him. 
2 CONT Joseph C. Anderson was never a resident of the district from first to last. He was the autho
2 CONC r of the "Black Laws" passed by this Legislature. 
2 CONT Samuel A. Williams was originally from Kentucky. He came here first in 1854, and afterwards b
2 CONC rought his family, about six months before election, from Polk County, Missouri, driving an o
2 CONC x cart, containing his family, his chickens and two "cheers." He was no "voter." He had com
2 CONC e to stay. He was a good man, a good citizen, and held many important positions. He died at h
2 CONC is home in Fort Scott, August 13, 1873. 
2 CONT John Hamilton was "left over" from the regular army. He lived here in the town and in the cou
2 CONC nty until after the war, as has been stated.

2 CONT THE FIRST LBGISLATURE 
2 CONT The first Legislature convened by order of the Governor at Pawnee, near Fort Riley, on the 2n
2 CONC d of July, 1855. Pawnee was 100 miles west of the Missouri State line at Westport. Governor R
2 CONC eeder said he took it out there to get it out of the way of political influence and to keep t
2 CONC he legislators unspotted from the world. That was certainly the right idea and the right plac
2 CONC e if he could have made them stay there, but he couldn't do it. The statesmen said it was to
2 CONC o dry, and too far from their base of supplies; and besides, as there were no houses in Pawne
2 CONC e, or in forty miles of it, they had to sleep in their wagons, or under them; and then agai
2 CONC n they had nothiug to eat but jerked buffalo and Pawnee macarroni. This latter was a very suc
2 CONC culent dish much sought after by the Pawnee Indians. It was made from the small entrails of a
2 CONC ntelope and fish-worms. The origin of this war-like tribe arose from this dish. Most any bod
2 CONC y wonld. The statesmen arose from it. Said they liked the legislature business all right enou
2 CONC gh but this wasn't an adjourned session of the Diet of Worms; they were not elected on that t
2 CONC icket. Said they didn't know what other Kansas Legislatures might do - No man in his right mi
2 CONC nd could tell, but as for their part they could not entertain such a diet, anyway, without so
2 CONC mething to go with it, and they didn't even have Bourbon County corn bread. Besides, they wan
2 CONC ted to be nearer home where they could hear the honest coon-dog's deep-mouthed bay. So next m
2 CONC orning they hitched up and drove down to Shawnee Mission, near Westport. That was as near hom
2 CONC e as they could get without going "plum over" into Missouri. Reeder could do nothing but se
2 CONC t around and scratch his head and pawnee. He finally followed them down to Shawnee Mission. H
2 CONC e told them they could not legally move, and could pass no valid laws if they did. They tol
2 CONC d him to be quiet or they would pass him down the Missouri river on a raft. That made him mad
2 CONC der than ever and he called them a lot of Border Ruffians. Then Stringfellow smote him hip an
2 CONC d thigh, "and they wrote a letter unto the king," saying what a bad man this Reeder was, "an
2 CONC d the king dismissed him with contumely." But the name give to them by Governor Reeder of Bor
2 CONC der Ruffian stuck to those fellows, and their kind, even to the third generation. Ainsi soi

2 CONT THE BOGUS STATUTE. 
2 CONT The Legislature then went to work to pass laws for Kansas. It was now the 16th of July. By th
2 CONC e 1st of September they had finished their labors which resulted in the preparation of an imm
2 CONC ense code of "laws," which have always been called and known as the "Bogus Statute of 1855.
2 CONC " This Statute was called bogus principally because many of the members were not residents o
2 CONC f the Territory, and they were themselves bogus; the elections were fraudulent in nearly ever
2 CONC y case, consequently their office was bogus. The sessions were held at Shawnee Mission agains
2 CONC t the will, order and veto of the Governor who had the only legal right to decide that point
2 CONC , as he claimed, consequently the whole business really had no legal status or right to be. B
2 CONC ut it was the prologue of the opening drama. The Pro-slavery men here showed their hand and t
2 CONC he true spirit and intent of their party. They at once became blustering, arrogant, defiant a
2 CONC nd overbearing, and continually sought to pick quarrels with, and embroil every man into diff
2 CONC iculties who opposed them. The few scattering and unorganized Free State men, in contemplatio
2 CONC n of such acts and such men, stood with raised and outstretched hands as if warding off a blo
2 CONC w. 
2 CONT SAMPLE OF LEGISLATION. 
2 CONT The Legislature did more by its drastic, ill-tempered and senseless legislation to destroy th
2 CONC e prospect of making Kansas a slave State than did all the Emigrant Aid Societies, John Brow
2 CONC n and other Nortbern fanatics put together. As a sample of their legislation and to show th
2 CONC e spirit which controlled the Pro-slavery side on the threshold of the struggle, the followin
2 CONC g section of their laws is quoted: 
2 CONT "SEC. 12. If any person, by speaking or by writing, assert or maintain that persons have no
2 CONC t the right to hold slaves in the Territory, or shall introduce into Kansas, print, publish
2 CONC , write, circulate, or cause to be introduced into the Territory, any book, paper, magazine
2 CONC , pamphlet or circular containing any denial of the rights of persons to hold slaves in thi
2 CONC s Territory, such person shall be deemed guilty of a felony, and punished by imprisonment a
2 CONC t hard labor for a term not less than two years." 
2 CONT This made it a penitentiary offense for a person to take a Free-State paper, or to argue th
2 CONC e question with a aeighbor, even at his own fireside. The present generation cannot conceiv
2 CONC e that a body of educated and intelligent American men could have seriously placed such a law
2 CONC , and a hundred of similar tenor and import on the statute books of a State. But the indescri
2 CONC bable fanaticism on the question of human slavery had made them, as a people, just that intol
2 CONC erant. 
2 CONT On the other hand the Northern people, as a people, said to the South exactly this: We have m
2 CONC ade a constant, consistent and honest effort to restrict slavery to its present limits, and a
2 CONC lthough the sacred compact which has stood for a third of a century is broken down, let us pe
2 CONC acefully abide the provisions of the squatter sovereign principle. And we now say to you Sout
2 CONC hern people, and you may be fully assured that, although we shall not desist from those open
2 CONC , honest efforts which we have constantly made for restriction and which efforts will be vigo
2 CONC rously continued to make Kansas a Free State, we shall neither openly or secretly resort to a
2 CONC ny measures which can tend to disturb the tranquillity of the slave States, or thereby to aff
2 CONC ect the prosperity of the Nation. And thus at the commencement of that most momentous era wa
2 CONC s the virgin Territory of Kansas handed over to those two contending sections, who had "com
2 CONC e to ope the purple testament of bleeding war." 
2 CONT It looked dark for the side of Freedom. Its enemies controlled the Administration; they contr
2 CONC olled all the branches of the Territorial Government and they controlled the front door throu
2 CONC gh which emigration must enter. 
2 CONT BOURBON COUNTY ORGANIZED. 
2 CONT The buildings erected and the improvements made by the Government at Fort Scott were estimate
2 CONC d to have cost $200,000. They were sold at public auction on the 16th day of May, 1855, by Ma
2 CONC jor Howe, Assistant Quartermaster of the U. S. Army, for less than $5,000 for the whole busin
2 CONC ess. The officers quarters the four principal blocks of buildings, were disposed of as follow
2 CONC s: A. Hornbeck bought the first block, on the west corner of the Plaza for $500. H. T. Wilso
2 CONC n the next for $300, B. Greenwood the next for $505, and J. Mitchell bought the next buildin
2 CONC g on the east for $450. The other buildings were sold to different parties for nominal sums
2 CONC . Of course, this not being a Government Reservation, the title to the land on which these bu
2 CONC ildings stood did not pass by this transaction, and it was so understood by the purchasers. B
2 CONC ut they concluded to "let the hide go with the tallow," and take their chances of acquiring t
2 CONC itle either from the Government as preemptors, or, that some time in the future when the tow
2 CONC n shall have been surveyed and platted, and a legally incorporated town company organized, th
2 CONC ey could obtain deeds. This plan was agreed on and was afterwards carried out.

2 CONT Elisha H. Rollins, partner of Mr. Ireland in the proprietorship of the Ireland & Rollins Plan
2 CONC ing Mills Company, and one of the progressive and energetic business men of Fort Scott, was b
2 CONC orn March 15, 1859, on Prince Edward Island, a son of John and Mary (Harker) Rollins, native
2 CONC s of that place, who passed their entire lives there in agricultural pursuits. The father die
2 CONC d in 1909, at the age of seventy-five years, while the mother passed away many years before
2 CONC , being forty-seven years old at the time of her demise.

2 CONT The fourth in a family of nine children, Elisha H. Rollins received a public school education
2 CONC , and in his youth learned the trade of carpenter, which he followed at his native place unti
2 CONC l 1876. In that year he came to Kansas City, Missouri, where he followed his trade for thre
2 CONC e years, and then came to Fort Scott and continued at his trade as a journeyman until he join
2 CONC ed Mr. Ireland in the planing mill business. Like his partner, Mr. Rollins is a man of foresi
2 CONC ght and good judgment, a thorough business man, and a citizen of high character and standing
2 CONC . He is a republican in politics, a Presbyterian in his religious faith, and a member of th
2 CONC e Independent Order of Odd Fellows and the Fraternal Union.

2 CONT On August 30, 1886, at Fort Scott, Mr. Rollins was married to Miss Jennie Margrave, daughte
2 CONC r of Hon. William and Sarah (Hefton) Margrave. They have one son: William M., born October 22
2 CONC , 1888, a graduate of the Fort Scott High School and the Kansas State Normal School, of Pitts
2 CONC burg, who has taught three years in the public schools of Fort Scott and two years in the Wic
2 CONC hita High School.

2 CONT Hon. William Margrave, father of Mrs. Rollins, was born in Barton County, Missouri, January 1
2 CONC 7, 1818, studied law, was admitted to the bar in Missouri in 1851, and in 1854 came to Fort S
2 CONC cott. In November of that year he was appointed justice of the peace by Governor Andrew Reede
2 CONC r, and his subsequent service in that office has never been equalled in continuity, for had h
2 CONC e lived but a few months longer he would have rounded out a half century in that position o
2 CONC f honor and responsibility. His death occurred September 29, 1904, when the people of city, c
2 CONC ounty and state mourned. Coming to the town of Fort Scott when it was still in its infancy, h
2 CONC e watched its growth and development through the passing years, and did much to assist in it
2 CONC s transformation into one of the leading cities of the West. He was the first justice of th
2 CONC e peace in the State of Kansas, and, unlike many who came after him, had a thorough knowledg
2 CONC e of civil and criminal law, so that he was able to dispense justice in a fair manner, as evi
2 CONC denced by the fact that his decisions were seldom reversed. He was a remarkably fine judge o
2 CONC f character and human nature, and while he was stern and courageous in his handling of law-br
2 CONC eakers, was at heart kindly disposed and a stanch and tried friend of the unfortunate. In hi
2 CONC s death Fort Scott lost one of its first and foremost citizens, a man universally respected a
2 CONC nd beloved.

2 CONT was in Caldwell Co., KY by 1809. Jesse was listed on 1814 Caldwell Co., 
2 CONT KY census. Left for Bond Co., IL about 1817 with son John along with the 
2 CONT Wafer and Horition Durley families. John and his family and the Wafer 
2 CONT family went in one wagon, each furnishing half of the team. Both Jesse 
2 CONT and son John were listed in 1820 census for Bond Co., IL. Jesse and his 
2 CONT wife, Mary left Bond Co., IL in 1835-36 with their son Felix and went to 
2 CONT Putnam Co., IL The history of Marshal and Putnam Counties in IL states

2 CONT Recorded history concerning the Margrave family dates at least as far back as 1814, with th
2 CONC e birth of James Willis Margrave in Kentucky on August 16th. In 1838, he married Elizabeth Ho
2 CONC pkins in Putnam County, Illinois. The Margraves had eight children, including William Addiso
2 CONC n Margrave, born on May 1, 1845, near Peoria, Illinois. The family moved to the far southeast
2 CONC ern tip of Nebraska, near Preston. It was in this area, extending into northeastern Kansas, w
2 CONC here the Margraves bought extensive tracts of land for cattle ranching.

2 CONT W. A. Margrave, who was the leading family member in the cattle business, married Margaret Ru
2 CONC beti. Margaret's father was Wah-se-con, a Sac and Fox Indian; her mother, Jean Rubeti, a Fren
2 CONC ch Canadian who lived near the Sac and Fox Reservation. After the death of her parents in 185
2 CONC 1 (when Margaret was six years old), she and her sisters were raised by the Samuel Irvin fami
2 CONC ly, missionaries to the Iowa and Sac and Fox Indians.

2 CONT Over time, the Margrave Ranch became one of the largest ranching enterprises in either easter
2 CONC n Nebraska or Kansas. By 1920, the Margrave ranch was incorporated as the W. A. Margrave Comp
2 CONC any.

2 CONT William A. and Margaret Margrave had five children: Julia, Margaret Lunette (who died at birt
2 CONC h), William Charles, James Thomas, and Earl Irvin, all of whom were members of the Sac and Fo
2 CONC x tribe.

2 CONT After the death of William A. Margrave from a horse and buggy accident in 1906, William Charl
2 CONC es Margrave became president of the W. A. Margrave Company. He married Mary Waller, of Padoni
2 CONC a, Kansas, in 1897, and had four children: William (who died in 1899), Howard, Julia, and Mar
2 CONC tha. Mary died in 1908. Two years later, William married Ida E. Pribbeno of Preston, Nebraska
2 CONC . They had three children: Helen, William A. "Skeets," and Warren Robert (who died in 1924).

2 CONT In addition to his ranching activities, William C. Margrave was an advocate for Indian right
2 CONC s and represented the Sac and Fox on business and government matters. He was also a member o
2 CONC f the Indian Rights Association.

2 CONT A dramatic and tragic event in the history of the Margrave family occurred on November 11, 19
2 CONC 33, when Sam Martin entered Margrave property and incited a gun fight. James Margrave (Willia
2 CONC m Charles' brother) was killed, as well as James' two sons, William and Stuart. James' wife
2 CONC , Mary, was wounded, but survived. Martin was subsequently found guilty of murder and serve
2 CONC d a life sentence in the Nebraska State Prison. Mary and her daughter Margaret, sold their ho
2 CONC me in Nebraska, moved to the east coast, and never returned.

2 CONT William C. Margrave died in 1942 of diabetes.

2 CONC rtheastern Kansas. The Margraves, a family of Sac and Fox Indian extraction, owned a great de
2 CONC al of land, which they used for cattle ranching. Most of the papers in this collection consis
2 CONC t of business papers in connection with the Margrave's cattle ranching business, such as rea
2 CONC l estate papers, property tax receipts, account ledgers, stock certificates, and minutes of m
2 CONC eetings of the board of directors. Other papers concern government relations with the Sac an
2 CONC d Fox Indians, financial contributions to Baker University and the estates of William Addiso
2 CONC n Margrave and William Charles Margrave.

2 CONT The Kansas State Historical Society also has photographic reproductions of 52 photos of the M
2 CONC argraves. The originals are in the hands of Suzanne Heck, who loaned the collection to the Ka
2 CONC nsas State Historical Society.

2 CONT When William Addison Margrave befell a horse and buggy accident on July 31, 1906, he died int
2 CONC estate, meaning, he died without a will. Series 2 contains the court transcripts of the Richa
2 CONC rdson County (Nebraska) District Court, which determined the allocation of the Margrave prope
2 CONC rty. Oddly enough, the District Court did not issue a decree on the fate of the estate unti
2 CONC l 1919, thirteen years after Margrave's death. One of the most significant features of the si
2 CONC x transcripts in this series is that they give a complete legal description of all of the par
2 CONC cels of the Margrave property.

2 CONT There are six transcripts on the Margrave property because the family owned property in fiv
2 CONC e different counties.

2 CONC e of the first missionaries to the region.
